These Terms of Use ("Terms") govern your use of the Neary app and the website myneary.com ("Neary", "the Service"), provided by Sisman by At Apps ("we", "us"). By installing or using Neary you agree to these Terms. If you do not agree, please do not use Neary.

1. What Neary does
Neary helps you find places near you (such as pharmacies, supermarkets or restaurants), view details, open directions in your preferred navigation app, save favorites, share your location, and optionally contribute photos and ratings. Some features are free; others are part of a paid Premium upgrade.

2. Who may use Neary
You must be old enough to enter into a binding agreement in your country, or use Neary with the permission and supervision of a parent or guardian. You are responsible for any use of Neary on your device.

3. Acceptable use
You agree not to:

use Neary for anything unlawful, or to harass, stalk, track or endanger anyone;
upload content that is illegal, offensive, misleading, pornographic, violent, or that infringes someone else's rights;
upload photos showing identifiable people without their consent, or photos that do not show the place you assign them to;
manipulate ratings, create fake contributions, or bypass upload and rating limits;
attempt to hack, overload, scrape, reverse engineer or disrupt the Service or our servers;
use automated tools to access the Service in a way we have not permitted.

4. Location sharing and consent
Neary lets you share your position with others (live sharing, Friends, or sending a link by SMS or another app). Only share your location with people you trust, and only track or view another person's location with their knowledge and consent. You are responsible for what you share and with whom. If you share your location with or on behalf of a child, you are responsible as a parent or guardian.

5. Your content and the license you grant us
Photos and other content you submit to Neary ("Your Content") remain yours. You confirm that you took the photo yourself and that you have all rights needed to submit it.

By submitting Your Content you grant Sisman by At Apps a worldwide, non-exclusive, royalty-free, perpetual and irrevocable license to use, store, reproduce, resize, adapt, display, distribute and share it, in and outside the Neary app, in any media, for operating, improving and promoting Neary and its services. This license can be sublicensed to our service providers. You are not paid for Your Content.

Photos are tagged with the place and its category and are visible to other users. We may review, refuse, edit or remove any content at any time, for example after a report, and we may block users who break these Terms. You can report a photo or block a contributor from within the app.

6. Ratings
You can give a place one rating from 1 to 5 stars. The average rating is shown to all users. Ratings reflect the opinions of users, not ours.

7. Place information and third-party services
Place data (names, addresses, categories, opening hours, photos, ratings, phone numbers, coordinates) comes from third-party sources, including OpenStreetMap contributors, and from other Neary users. It can be incomplete, outdated or wrong. Always check important details, such as opening hours, yourself.

Directions are opened in third-party apps (for example Google Maps, Apple Maps, Waze or HERE WeGo). Those apps are not controlled by us and have their own terms and privacy policies. Follow traffic laws and local rules, and do not use your phone while driving.

8. Not for emergencies
Neary is not an emergency service. Features such as "Send location" or live sharing may be helpful, but they depend on your device, GPS accuracy, mobile coverage, battery, permissions and the recipient. We cannot guarantee that a location is accurate or that a message is delivered or read. In an emergency, contact your local emergency number directly.

9. Premium and purchases
Premium (for example removing ads and creating custom favorite categories) is bought through Google Play, and payment, billing, cancellation and refunds are handled by Google Play under its terms. We may change the features and price of Premium for future purchases. If a Premium feature stops working because of a purchase issue, contact us.

10. Advertising
The free version may display ads from third parties. We are not responsible for the content of ads or for third-party websites and apps you open through them.

11. Availability and changes
We aim to keep Neary running but do not promise uninterrupted or error-free service. We may change, suspend or discontinue features at any time, including features that rely on third-party providers. Free features and data providers may change or become limited.

12. Intellectual property
Neary, including its name, logo, design, app code and website, is owned by Sisman by At Apps and protected by law. You may use Neary for your own personal purposes in line with these Terms. You may not copy, sell or reuse any part of it without permission. Map data from OpenStreetMap is © OpenStreetMap contributors and available under the Open Database License.

13. Disclaimer of warranties
To the extent permitted by law, Neary is provided "as is" and "as available", without warranties of any kind, whether express or implied, including accuracy, reliability, fitness for a particular purpose and non-infringement.

14. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, loss of data, loss of profit, or for damages arising from reliance on place information, location accuracy, user content, third-party services or an interruption of the Service. Where our liability cannot be excluded, it is limited to the amount you paid us for Neary in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, such as liability for intent or for injury to life, body or health, or your statutory consumer rights.

15. Ending your use
You can stop using Neary at any time by uninstalling it. We may suspend or end your access if you break these Terms or if we are required to by law. Sections that by their nature should continue (such as the license to Your Content already shared, disclaimers and limitation of liability) stay in effect.

16. Changes to these Terms
We may update these Terms. The current version is always available at myneary.com, and the date above shows when it was last changed. If you keep using Neary after a change, you accept the updated Terms. We will tell you in the app about important changes.

17. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. If you are a consumer, you also keep the mandatory consumer protection rights of the country where you live.
